Information letter about the modified Toll Declaration Operators' General Terms and Conditions

Please note that there is a change in the GTA concerning Toll Declaration Operators valid as of 9 February 2014.

You are kindly requested to read the following information letter and the changed GTAC concerning Toll Declaration Operators for details. NÚSZ Zrt. provides a switch-over period between 9 and 15 February 2014 (7 days). During this period you can make the necessary settings via the relevant channels as described below.

About those regulations of the document “General Terms and Conditions for the individual contract related to the data provision of toll declaration operators”

 that most particularly affect the Customers

 

Dear Customer,

We would like to inform you that at 00:00 am 09.02.2014 the “General Terms and Conditions for the individual contract related to the data provision of toll declaration operators” (hereinafter: GTAC),document will enter into effect  now containing all of the latest modifications integrated.

Pursuant to the provisions of the General Terms and Conditions relevant for the Customers, it is not only the contents of the GTAC itself but also its provisions related to the toll declaration operators that must be understood as binding to the Customers. Considering this, we would like to request that all of our Customers study the provisions of the modified GTAC; in addition, we would like to draw your attention to those changes, listed below, that affect our Customers, and which are most important for you and require your special attention.

The list below is not exhaustive, therefore studying the GTAC is highly advisable (it is available on the www.hu-go.hu web site under the GTAC menu item).

I.          Number of axles (hereinafter: JDB), settings and related new provisions,

II.        Calculation of the Missed Road Sections settings and related new provisions,

III.       Data provision deadlines and related new provisions.

I. The new JDB settings system

09.02.2014 from 00:00 am Customers must decide whether they wish to set the number of axles (JDB)

-      through the hu-go.hu web site, or

-       via a Toll Declaration Operator with the help of On Board Units provided by the Toll Declaration Operator.

1. Setting through the hu-go.hu web site

In this option, the switch can be set to Through the Hugo Portal or to Through a toll declaration operator.

If you select the Through the Hugo Portal setting, you will be able to set and change the number of axles only here, through the web site interface. In this case, the Toll System will initiate the Toll Declaration based on the last effective number of axles set on the online surface.

We would like you to note that if you switch from the Through the Hugo Portal setting to the Through a toll declaration operator setting, the value previously set on the web site will remain in effect until the JDB first takes effect; therefore you must not travel with your vehicle until the first modified JDB value takes effect, as you may be fined.

If you select the Through a toll declaration operator option, then the setting can be switched only as a result of the following procedure and by the approval of the Toll Declaration Operator.

a)   When the switch is changed, the Toll System searches for the Toll Declaration Operator of the given Customer in order to allow the Toll Declaration Operator to confirm to the Toll System the fact that the given Customer’s On-Board Unit or any other system is capable of communicating the JDB setting through the involvement of the given Toll Declaration Operator, and whether the Toll Declaration Operator agrees to the task.

b)   If the Toll Declaration Operator approves the request, no error message will be displayed and the switch is successfully completed. In this case, the JDB value can be changed according to the method described under Setting the JDB value Through a toll declaration operator.

c)   If the Toll Declaration Operator’s return message disapproves, the switch cannot be changed to the Through a Toll Declaration Operator setting, and the following error message will be displayed: „The switch failed, please contact with your Toll Declaration Operator”. In this case we request that you contact your Toll Declaration Operator to learn the reasons of the disapproval. One such reason could be that there is no change number of axles option on the On-Board Unit.

2. Setting the JDB value through a toll declaration operator

If you wish to change the JDB value through a Toll Declaration Operator, then a specific procedure will give you that option. At the end of the procedure, the new JDB value will take effect. The motor vehicle must not travel until the setting takes effect. If the switch is carried out while traveling, the Toll Declaration will be made based on the old, erroneous JDB data, which is attributed to the Customer and therefore is subject to penalty. The JDB value that took effect earlier will lose effect when the new JDB value takes effect or when setting is moved to the Through the HUGO Portal found on the hu-go.hu system.

The proceedings of the JDB setting procedure:

As the first step of the procedure, the Customer or the person authorised to act on his or her behalf changes the JDB value on the on-board unit or through the interface provided by the Toll Declaration Operator. This is recognised by the Toll Declaration Operator who notifies the system of the fact of the switch. Immediately following the notification, the Toll System sends a confirmation to the Customer via email, whereby the new JDB value takes effect. As a safety measure, the Toll System also notifies the Toll Declaration Operator, who sends a notification to the Customer through its own system also. The vehicle may begin to travel from the time the value takes effect, as the declaration will be considered with the new JDB value by the Toll Declaration Operator when completing the data provision.

Period:

In order to rule out misunderstandings and errors, the National Toll Payment Services PLC will set the JDB switch to the  Through the HUGO Portal (the default setting) at 00:00 am 09.02.2014 for each Customer who chooses a Toll Declaration Operator for toll declaration. After this, each Customer will need to change their switch according to their choice based on the above procedural order. The National Toll Services Ltd. will allow  a 7-day period for these changes to be made through 12:00 am  15.02.2014. At the beginning of the change period, the National Toll Payment Services PLC will consider the JDB value set by the Customer through the web site (which is to be completed through 11:59:59 pm 08.02.2014) as the default setting.

For this reason, we request that all of our Customers complete setting the JDB value through the website interface by 00:00 am 09.02.2014, select the JDB change option most suitable for them, and ensure that their correct JDB value is set within the changing period, as well as continuously afterwards. Until the change has taken place, toll declarations will be initiated based on the default JDB value. You can change settings after the changing period also, in fact, it is our Customers’ responsibility to ensure the correct JDB value. 

The most important point of the changing period is that the Through the HUGO Portal setting and the default JDB value set on the hu-go.hu web site will be set each customer.

 3. Warning!

Our Customers must ensure during the changing period that correct JDB value is set after the change has been completed, either through the HUGO Portal or with the involvement of a Toll Declaration Operator, with the effective JDB value.

We would like to emphasise, again, that your vehicle must not travel until the new JDB value set through the Toll Declaration Operator has taken effect.

After the changing period, Customers must continuously ensure that the correct JDB value is set. Incorrectly set JDB value may result in an administrative fine.

 

II.   Calculation of the Missed Road Sections settings and related new provisions

Pursuant to the provisions of the GTAC entering into effect at 00:00 am 09.02.2014, the Toll Declaration Operator is obligated to send a Report of the Missed Road Sections to the new Toll System if the position data related to certain road sections have not arrived from the on-board unit, and there are or there may be toll sections between the two known position data and the rules of route-setting cannot be applied.

Based on the Report of the Missed Road Sections the Toll System

a)       will initiate toll declaration based on ostensible road use between the two known points with the exception of the case in point b),

b)       will not initiate toll declaration between the two known position data if the provisions of the GTAC exclude the possibility of initiation.

The Customer may submit a complaint against the ostensible road use and may prove that he or she traveled on a road other than the ostensible road use. The Toll Declaration Operator sends a notification about the Report of the Missed Road Sections to the Customer.

If the Toll System does not initiate toll declaration based on the ostensible road usage between the two known position data and the control system detects the vehicle, or if the vehicle is traveling on a route other than the ostensible road usage and the control system detects the motor vehicle of the Customer, a fine will be charged. In this case the toll potentially collected based on the ostensible road usage will be refunded to the Customer’s account.

 

 

Warning!

We request that you travel with your vehicle only if you have verified that your on-board unit is operational; if you become aware that the unit is out of order please stop your journey immediately and make an alternative plan to acquire road usage authorisation. There is no possibility to acquire road usage authorisation retrospectively. Customers may not cite Calculation of the Missed Road Sections and ostensible road usage as an excuse against the penalty.

 

III. Data provision deadlines and related new provisions

Pursuant to the provisions of the new GTAC taking effect at 00:00 am 09.02.2014, from 00:00 am 09.02.2014 the Toll Declaration Operator is entitled to data provision in the Toll System only within 25 days following the actual road use and not thereafter (in other words, there is no possibility to acquire road usage authorisation by sending data details even in case of a penalty charge).

Warning!

We would like to request all of our Customers, particularly in compliance with Section 26 paragraph (2) of Government Decree 209/2013, to ensure the conditions for the proper use and appropriate operation of the On Board Device, as it is a pre-condition to ensuring the soonest possible transmission of the data related to road usage to the Toll Declaration Operator.

This bears salient importance as this is the only way that important information can be provided by the Toll System to the Customers (e. g. currently available balance, low balance notification, black listed status notification, etc.).

We would like you to note that in extraordinary cases, such as out-of -the-country status or repair service, when the communication of the on-board device will foreseeably be suspended, please verify the pre-conditions are met for successful data provision, or the existence of the declaration on last road use, as the deadline for sending the data related to road use is within the 25th day from actual road use.

The route based on the declarations initiated based on the data provision can be studied anytime in the Toll System.
